Estate Planning — Bangkok Family
A family with property in Thailand and Australia
Challenge
A couple in their sixties held substantial property in Thailand alongside retirement assets in Australia. They had no formal wills in either jurisdiction and were uncertain how their assets would be distributed on the first death.
Our approach
We conducted an estate planning conversation covering both the Thai property and the cross-border dimension. We coordinated with their existing Australian adviser on the Australian assets and prepared a written summary of recommendations for the Thai elements.
Outcome
A Thai will was prepared in accordance with the couple's wishes, with clear provision for the Thai assets. Both parties felt the matter was settled in a way that reflected what they actually wanted. Duration: six weeks from first contact.
Probate Conduct — Multi-Heir Estate
Four siblings and an undivided estate
Challenge
A father passed away leaving a will that distributed his estate equally among four children. One of the children was working abroad, and communication between the siblings was strained before the matter reached us.
Our approach
We managed communications with all four siblings directly, keeping each informed at the same time to avoid any perception of preference. Court filings were prepared and submitted to appoint an administrator, and we coordinated the verification of assets across two provinces.
Outcome
The estate was administered and distributed in accordance with the will without litigation. The sibling abroad was kept involved throughout via email correspondence in English. Duration: approximately five months.
Inheritance Litigation — Contested Will
A will challenged on grounds of undue influence
Challenge
A client's sibling sought to set aside their parent's will, alleging that the testator had been unduly influenced at the time of execution. The estate included a Bangkok property of significant value.
Our approach
We assembled evidence of the testator's capacity and independence at the relevant time, prepared detailed pleadings in response to the challenge, and represented the client through two court hearings. We maintained a calm, factual approach throughout, including when opposing submissions were aggressive in tone.
Outcome
The will was upheld. The court was satisfied on the evidence that the testator had acted of their own volition. Our client was able to administer the estate as their parent had intended. Duration: eight months including one appellate hearing.
