How long does the probate process typically take in Thailand?
The duration varies considerably depending on whether a will exists, how many heirs are involved, and whether any disputes arise. Straightforward cases may conclude within three to six months; matters involving multiple heirs or cross-border property can take longer. We will give you a considered view of likely timelines at the outset of any engagement.
Can a foreign national inherit property in Thailand?
Thai law places restrictions on foreign nationals owning certain categories of land, but inheritance arrangements can still be structured in ways that protect the interests of non-Thai heirs. We work through these questions carefully, examining what the estate holds and what forms of ownership or transfer are permitted under current Thai law.
What happens if there is no will?
Where no will exists, the estate passes under the statutory succession rules of the Thai Civil and Commercial Code, which establish a clear order of priority among relatives. We can explain how these rules apply to your specific family situation and assist with the appointment of an administrator to manage the process through the courts.
How are your fees structured?
Each service has a clearly stated fee, which is agreed in writing before work begins. For the Estate Planning Conversation the fee is ฿2,400; for Probate Conduct with Heir Coordination ฿9,200; and for Full Inheritance Litigation ฿10,800. Any scope adjustments that would affect the fee are discussed with the client in advance.
Can I engage you if the matter is already before the court?
Yes. We are able to accept mandates in matters that are already in progress, though we would first need to review the current state of proceedings before committing to a scope of work. Please contact us to arrange an initial discussion.
How do you handle sensitive family dynamics?
We approach family estates with an awareness that the legal matter is often only one layer of what is involved. Our communications with heirs and family members are measured and respectful, and we are careful not to inflame tensions that are already present. Our aim is to keep the process moving in a constructive direction while being sensitive to the relationships involved.
